DNA SPECIMEN DESTRUCTION AND RECORD REMOVAL PROCESS

PROVIDE THIS INFORMATION TO THE OFFENDER AT THE TIME OF DNA COLLECTION

This web page contains information regarding the removal of an offender DNA specimen and DNA record from the database based on specific criteria in accordance with Utah State Code 53-10-406(6).

You may petition the Utah Department of Public Safety Bureau of Forensic Services for removal of your DNA specimen and associated records as follows:

If Sample was Collected at Booking

A written request for destruction of DNA specimen and associated record along with a certified copy of one of the following:

  • A declination to prosecute from the prosecutor OR
  • A court document indicating all charges have been resolved by dismissal with prejudice or acquittal

If Sample was Collected after Conviction

A court order for destruction of DNA specimen and associated record along with a certified copy of ONE of the following:

  • A court order reversing the conviction or judgment OR
  • A court order to set aside the conviction OR
  • The dismissal or acquittal of the charge(s)
